That the Planning Advisory & Committee of Adjustment recommend to the Council of the Corporation of the Township of Rideau Lakes that Zoning By-Law Amendment application ZBA-3-2023, by Jennifer Holden of the Ward of North Crosby-Newboro, be approved as amended which will rezone the subject property from Rural (RU) to Rural Special Exception (RU-X). The proposed RU-X zone will permit all uses in the RU zone as well as an Off-Leash Dog Park. The Special Exception is also to allow for a Kennel to be located 240m from a residential use and for a new sensitive land use to be 233m from land zoned Disposal Industrial. The request excludes the lands zoned Environmental Protection - B (EP-B). The amendment will require 1 parking space per 25m2 of floor area for the proposed Kennel (grooming shop) and 1 parking space per 200m2 of fenced in area for the proposed Off-Leash Dog Park.

WHEREAS the owners developed the lot at 499 Bush Road and the adjacent lot to support multi-generational housing; AND WHEREAS the Township supports this form of housing; AND WHEREAS at the time of development the Township’s policies and by-laws were still in the process of being updated to reflect the evolving public interest around housing; AND WHEREAS as a result, one house is on a separate lot, but they function cohesively as a common development and share a common access driveway; NOW THEREFORE Council authorizes the issuance of civic address 499B for the house on the separate lot based on common driveway access, and in so doing satisfies access concerns for emergency services. NOW THEREFORE this authorization will become invalid at the time of the transfer of either lot to an unrelated party, at which time a separate driveway access to the public road will be required for both lots, and civic addresses will need to be adjusted accordingly. This shall be reflected in an updated clause in the currently in place development agreement; NOW THEREFORE the Township shall waive/absorb any fees associated to updating the civic address and/or updating the development agreement.
